  7. END-USER LICENSE AGREEMENT ("EULA") FOR THIS SOFTWARE:

  10. This EULA is a binding legal agreement between you (either an individual or a single
  11. entity) and the mentioned author of this Software for the SOFTWARE PRODUCT
  12. identified above, which includes computer software and may include associated media,
  13. printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT").
  14. By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be
  15. bound by the terms of this EULA.

  17. The SOFTWARE PRODUCT is protected by copyright laws and international copyright
  18. treaties, as well as other intellectual property laws and treaties. The SOFTWARE
  19. PRODUCT is licensed by the author, not sold.

  21. Each licensed copy of the Sea Moon Technology,Inc. software may be used in only one 
  22. single location by one user.  Use of the software means that you have loaded the program 
  23. and run it or have installed the program onto a computer.  If you install the software onto 
  24. a multi-user platform or network, each and every individual user of the software must be 
  25. licensed separately or be covered by a site license.

  27. You may make one copy of the licensed software for backup purposes, providing you only have 
  28. one copy installed on one computer being used by one person (or number of users covered in a 
  29. site license purchase).  Other users may not use your copy of this program.

  32. 1. Evaluation and Registration

  34. This is not free software. You are hereby licensed to use this software for evaluation
  35. purposes without charge for a limited functions. If you want use this software with full 
  36. functions a registration fee of $49.95 (US Dollars) is required.

  38. 2. Distribution
  39.  
  40. The Evaluation release (select the "About" tab to check) of this SOFTWARE PRODUCT may
  41. be freely distributed with as many copies of the Evaluation release of this software and
  42. documentation as you wish as long as exact copies of the original Evaluation release
  43. packages are distributed via electronic means. There is no charge for any of the above,
  44. the author just wants to receive a short mail informing about it which helps him to
  45. maintain the last versions around. Alternatively, you could also send us a reference
  46. CD, the URL of your website (when you link to the SOFTWARE PRODUCT) or a
  47. copy of the article about the SOFTWARE PRODUCT for reference purposes.

  49. 3. Responsibilities and Warranties.

  51. The Author of this Software expressly disclaims any warranty for the SOFTWARE
  52. PRODUCT. You acknowledge that the SOFTWARE PRODUCT is provided "as is"
  53. and "with all faults, defects and errors" without warranty of any kind, either express
  54. or implied, including, without limitation, the implied warranties or merchantability,
  55. fitness for a particular purpose, or noninfringement, and that all use of the Program
  56. is at your own full risk.

  58. No Liability for damages.
  59. In no event shall the author of this Software be liable for any damages whatsoever
  60. (including, without limitation, damages for loss of business profits, business interruption,
  61. loss of business information, or any other pecuniary loss) arising out of the use of or
  62. inability to use this product, even if the Author of this Software has been advised of
  63. the possibility of such damages. Because some states / jurisdictions do not allow the
  64. exclusion or limitation of liability for consequential or incidental damages, the above
  65. limitation may not apply to you. In this case the Author of this Software will only be
  66. liable for the amount of money you spent for this SOFTWARE PRODUCT in exchange
  67. for the return of the product, all copies, registration papers and manuals, and all materials
  68. that constitute a transfer of ownership from the customer back to the Software Author.

  70. 4. Limitations on Reverse Engineering, Decompilation, and Disassembly.

  72. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT,
  73. except and only to the extent that such activity is expressly permitted by applicable
  74. law notwithstanding this limitation.

  76. 5. Termination.

  78. Without prejudice to any other rights, the Author of this Software may terminate this
  79. EULA if you fail to comply with the terms and conditions of this EULA. In such event,
  80. you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.

  82. 6. Copyrights.

  84. All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to
  85. any images, photographs, animations, video, audio, music, text, and "applets" incorporated
  86. into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of
  87. the SOFTWARE PRODUCT are owned by the Author of this Software. The SOFTWARE PRODUCT is
  88. protected by copyright laws and international treaty provisions. The following applies for
  89. the registered/professional version only: Therefore, you must treat the SOFTWARE
  90. PRODUCT like any other copyrighted material except that you may install the SOFTWARE
  91. PRODUCT on a single computer provided you keep the original solely for backup or
  92. archival purposes.

  104. The author reserves the right to make exceptions to any of these conditions, or alter these
  105. conditions, at any time. However, you may always use these conditions instead of any altered 
  106. version if you prefer (note that this licence explicitly applies only to one version of the 
  107. program; therefore, if Sea Moon Technology,Inc. makes new conditions in connection with a 
  108. future version, you do not then have the right to apply these conditions to that version 
  109. instead).
